Release of Liability, Assumption of Risk & Arbitration Agreement

Every student accepts this agreement in the course's Start Here, before the first practice. This page is the public copy, so you can read it any time.

Yoga for Violinists · Violin.Yoga · Yoga for Musicians · Musicians.Yoga · all programs by Samuel Wexler

Version 2.0 · Effective November 2, 2026

Please read this whole agreement — it affects your legal rights. In short: (1) yoga, breathwork, meditation, and instrument practice carry real risks of injury, which you accept; (2) you give up your right to sue me and the others listed below for injuries — including injuries caused by our negligence (ordinary carelessness) — but you keep your right to bring claims for gross negligence, recklessness, intentional misconduct, or anything else the law doesn't let you waive (Section 10); (3) you'll check with a qualified health professional who knows your medical history before you start, and you'll respect your body's limits; and (4) any dispute will be resolved by individual arbitration or small-claims court — not a jury trial or a class action — unless you opt out of arbitration within 30 days (Section 12). This summary is here to help you read the agreement; the full terms below control. If you don't agree, please don't enroll or participate.

1. Who this agreement is between

  • “I,” “me,” and “my” mean Samuel Wexler, an individual — including when doing business as Yoga for Violinists, Violin.Yoga, Yoga for Musicians, Musicians.Yoga, Harmonious Reality, or any other name under which I offer the Program — and any business I own or control, now or in the future, that offers or delivers the Program.
  • “You” and “your” mean the person enrolling in or using the Program. (In the checkboxes in Section 16, “I” means you.)
  • “Released Parties” means me; my heirs, successors, and assigns; and everyone who helps create or deliver the Program, including instructors, guest teachers, assistants, contractors, collaborators, and anyone who appears or demonstrates in Program content.

2. What this agreement covers

  • The Program means everything I offer, under any brand, now or in the future, in any format: self-paced courses, challenges, mini-courses, memberships, and libraries; live and group sessions and cohorts (such as Y4V Live); one-on-one and personalized programs (such as The Harmonious Violinist); community spaces; and all videos, audio, written materials, demonstrations, and feedback. This includes the Program wherever you access it, such as at yogaforviolinists.com, violin.yoga, yogamusicians.com, musicians.yoga, samuelwexler.com, harmoniousreality.com, or musicforyogis.com, or on any other website, app, or platform I use.
  • The Activities means everything the Program teaches, demonstrates, or suggests, including: yoga postures — standing poses, balances, forward folds, twists, backbends (such as camel, bridge, and wheel), and inversions (such as shoulderstand, plow, and headstand); stretching, strengthening, mobility, self-massage, and body-mechanics work; breathing practices (pranayama), including breath retention; meditation, relaxation, and gazing practices; using props such as mats, blocks, straps, bolsters, chairs, and walls; and holding, playing, and practicing a violin, viola, or other instrument, including warm-ups and technique work.
  • This agreement applies whenever and wherever you do the Activities — at home or anywhere else you choose — including when you practice or apply anything you learned in the Program on your own, outside a lesson or session, at any time.

3. What the Program is — and isn't

  • Education, not healthcare. The Program is movement, breath, meditation, and music-practice education. It is not medical care, physical therapy, psychotherapy, or any other healthcare service, and it does not diagnose, treat, cure, or prevent any condition. I'm not your doctor, physical therapist, or other healthcare provider, and no provider–patient relationship is created. This is true even if anyone contributing to the Program holds a healthcare license or credential: no one provides healthcare services to you through the Program.
  • Injury prevention is a goal, not a guarantee. The Program is designed to help musicians practice in healthier, more sustainable ways and to reduce the risk of playing-related strain. But no program can eliminate the risk of injury, and I don't promise that the Program will prevent, reduce, or relieve any pain, injury, or condition, or produce any particular result. If a product comes with a refund guarantee, that guarantee is a refund policy only: a refund is your sole remedy under it, and it is not a promise of any health outcome.
  • Not a substitute. Never ignore, delay, or replace professional medical advice because of anything in the Program.

4. Your health: consult a professional first

  • Before you begin, and whenever your health changes, you agree to consult a qualified healthcare professional who knows your medical history — such as your physician or physical therapist — about whether the Program and its Activities are right for you, and to follow their advice.
  • This is especially important if you have or have had: any pain, injury, or playing-related condition (including in your neck, jaw, shoulders, arms, elbows, wrists, hands, back, hips, or knees); any heart, blood-pressure, breathing, neurological, or eye condition (including glaucoma); recent surgery or illness; pregnancy or recent childbirth; or medication that affects your balance, blood pressure, or alertness. Many people come to this Program because of existing pain — if that's you, professional guidance before you start matters even more.
  • You confirm that you are able to participate safely, or that a qualified healthcare professional has cleared you to participate, and that you will do the Activities only within any limits they set. You'll skip or modify anything they advise against, and you'll stop and seek care if you notice pain, dizziness, numbness, tingling, or any other warning sign.

5. The risks you accept

Injury is possible even when you follow instructions carefully and I take reasonable care. You understand and voluntarily accept all risks of the Activities, known and unknown, including:

  • Physical injury: muscle strains and tears; sprains; ligament, tendon, and joint injuries; overstretching and hyperextension; injuries to the back, neck, shoulders, hips, knees, wrists, and hands; falls and loss of balance; bruises and cuts; and aggravation of existing conditions.
  • Inversions and backbends: neck and spine injury (including disc or nerve injury) from inversions such as headstand, shoulderstand, and plow, or from deep backbends; increased pressure in the head and eyes; changes in blood pressure; dizziness; and fainting.
  • Breathing and meditation practices: lightheadedness, hyperventilation, and fainting (especially with breath retention); and, for some people, anxiety, emotional distress, or the surfacing of difficult memories.
  • Instrument practice: overuse and repetitive-strain injuries, tendinitis, nerve compression, and other playing-related conditions of the hands, arms, shoulders, neck, jaw, and back; and damage to your instrument, bow, or other property — for example, if it's dropped or knocked during practice.
  • Your environment: hazards in your space, flooring, furniture, props, equipment, and surroundings — including open flames if you use a candle for gazing practice.
  • Rare but serious events: fractures, herniated discs, heart or circulatory events, permanent disability, paralysis, or death.

6. Practicing remotely: you're in charge of your space

Because the Program is delivered online:

  • I can't see, supervise, spot, or physically assist you, and I usually can't watch your form, environment, or condition in real time. In live and one-on-one sessions, what I can see is limited by your camera and connection, and I may not notice a problem.
  • You're responsible for choosing a safe place to practice; for your floor, lighting, surroundings, props, and equipment; for the setup and safe handling of your instrument; and for stopping whenever an instruction is unclear to you.
  • You won't use the Program as a substitute for in-person supervision by a qualified instructor or healthcare professional.

7. Trust the wisdom of your body

A core principle of this Program is that you are the final authority on your own body. Move only within a comfortable, pain-free range. Never force a pose, stretch, breath practice, or repetition. Rest, modify, or skip anything that doesn't feel right for you that day — no explanation needed. Stop immediately if you feel pain, strain, dizziness, shortness of breath, numbness, or any other warning sign, and seek appropriate care. You accept responsibility for these choices.

8. Your release of claims — including negligence

To the fullest extent the law allows, you — for yourself and for your heirs, estate, family, and anyone who might make a claim through you — release and give up all claims against the Released Parties for any injury (physical or emotional), illness, death, or other loss of any kind, to you or your property, arising out of or relating to the Program or the Activities.

This includes claims based on the negligence (ordinary carelessness) of any Released Party — for example, a mistaken instruction, cue, demonstration, sequence, modification, or piece of feedback, or a failure to warn — as well as claims arising from any of the risks in Section 5.

In plain terms: you are giving up your right to sue the Released Parties for these injuries and losses, even if one of us was careless.

9. Promise not to sue; responsibility for claims

  • You agree not to sue or bring any other claim against any Released Party for anything released in Section 8.
  • To the extent the law allows, you agree to cover the Released Parties' reasonable losses and costs, including reasonable attorneys' fees (in legal terms, to “indemnify” them), from: (a) any claim made by someone else arising out of your participation — including a claim by your heirs, estate, or family about your injury; and (b) any claim brought in breach of this agreement. In an arbitration, the arbitrator decides any award of fees and costs under the applicable rules and law.

10. What you are not giving up

Nothing in this agreement releases or limits liability for gross negligence, recklessness, or intentional misconduct, or any other liability that cannot be released or limited under applicable law. If any part of this agreement goes further than the law allows, it will be limited to the maximum extent the law permits, and the rest stays in effect.

11. Live sessions and one-on-one work

  • Recordings. Live and group sessions may be recorded to deliver the Program and so participants can review them. I'll say so at the start of any session that's being recorded. You control your camera, microphone, and display name; if you'd rather not appear, turn your camera off or rename yourself. I'll use a recording in which you appear for promotion only if you separately agree to that in writing.
  • Community. You're responsible for your own conduct in group and community spaces and for following any community guidelines I publish.
  • Personalized feedback (including in one-on-one programs) is movement and music-practice education based on limited remote observation and on what you tell me. It is not a medical or physical-therapy assessment, diagnosis, or treatment plan. You're responsible for telling me accurately about your health, history, and injuries and keeping me updated; for deciding whether any suggestion is right for you; and for checking it with your healthcare professional where appropriate. Everything else in this agreement — including the release in Section 8 — applies fully to one-on-one work.
  • Technology. Internet, device, and platform problems happen; I'm not responsible for interruptions or losses caused by things outside my reasonable control.

12. Resolving disputes: arbitration (please read carefully)

12.1 Talk to me first. Before starting any claim, you agree to email me at legal@samuelwexler.com with your name, a description of the issue, and what you're asking for, and to give me 30 days to try to resolve it. I'll do the same before bringing any claim against you. Any deadline for bringing the claim is paused during those 30 days.

12.2 Binding individual arbitration. If we can't resolve it informally, any dispute between you and me arising out of or relating to the Program, the Activities, your purchase, or this agreement — including injury and negligence claims — will be resolved by final and binding arbitration before a single arbitrator, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at adr.org). The arbitration is seated in Denver, Colorado. Any hearing will be by video or phone, or on written submissions where the rules allow, unless the arbitrator decides an in-person hearing is necessary, in which case its location will be set under the AAA rules. Fees will be paid as set out in the AAA's consumer fee schedule, which caps your share; I'll pay the fees that schedule assigns to the business. The arbitrator may award any individual relief a court could award. The Federal Arbitration Act governs this Section 12.

12.3 Small claims court. Instead of arbitration, either of us may bring an individual claim in small claims court, as long as the claim qualifies there and stays there on an individual basis.

12.4 Individual claims only. Claims may be brought only individually — not as a plaintiff or class member in any class, collective, or representative proceeding — and an arbitrator may not combine different people's claims without everyone's consent. If this paragraph is found unenforceable for any claim, that claim must proceed in court, not in arbitration, and will be paused until any individual claims between us are resolved in arbitration.

12.5 No jury. If any claim proceeds in court, you and I both give up the right to a jury trial, to the extent the law allows.

12.6 Court backup. If this arbitration agreement doesn't apply to a claim, or is found unenforceable for it, that claim must be brought only in the state or federal courts located in the City and County of Denver, Colorado, and we both consent to those courts' jurisdiction, subject to Section 14.

12.7 Your right to opt out. You can opt out of arbitration (Sections 12.2–12.4) by emailing legal@samuelwexler.com within 30 days after you first accept this agreement, with your full name and the words “Arbitration Opt-Out.” Opting out won't affect any other part of this agreement — including the release in Section 8 and the court venue in Section 12.6.

12.8 Future changes. If I change this Section 12 in a future version, the change won't apply to any dispute you've already told me about or any claim already filed, and it won't apply to you at all unless you accept the new version.

13. Governing law

Colorado law governs this agreement and any dispute about the Program, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs Section 12.

14. If you live outside the United States

The Program is offered worldwide. If you live outside the United States and are a consumer, you keep any protections that the law of your country gives you and that cannot be waived by contract — including, where that law provides it, the right to bring a claim in the courts where you live. Sections 12 and 13 apply to you only to the extent they don't take those protections away. If any part of this agreement can't be enforced against you under that law, only that part is limited or set aside; everything else still applies — including your acknowledgment of the risks, your agreement to seek professional guidance, and your agreement to respect your own limits.

15. General terms

  • Severability. If any part of this agreement is found unenforceable anywhere, it will be limited or removed only as much as necessary, and only where it's unenforceable; the rest stays in full effect.
  • Survival. This agreement continues to apply after your access ends and after any refund or cancellation, and it covers everything that happened while you participated.
  • Versions. I may publish updated versions for future enrollments. The version you accepted (identified by its version number and date) governs your participation unless you accept a newer one; I won't change your version retroactively.
  • Successors. I may transfer this agreement to a business I own or control, or to a successor to the Program; its protections continue for them and for all Released Parties.
  • Whole agreement. This is our entire agreement about risk, release, and resolving disputes for the Program. My Terms of Service, Privacy Policy, and refund policy cover other matters; if any of them conflicts with this agreement on these subjects, this agreement controls.
  • Electronic signature and records. Your electronic acceptance — checking boxes, typing your name, and/or clicking to accept — is your signature and has the same effect as signing on paper. I keep a record of your acceptance (such as your name, email, the date and time, the version you accepted, and technical data such as IP address), as described in my Privacy Policy. You can ask me for a copy at any time.
  • Language. If this agreement is translated, the English version controls where the law allows.
  • Contact and notices: legal@samuelwexler.com
